General Terms and Conditions (GTC)
Katnook.de – Katrin Schilke
1. Scope & Provider
These General Terms and Conditions apply to all orders placed by consumers via the online shop of Katrin Schilke, Katnook, Alte Straße 19, 37115 Duderstadt, Germany (hereinafter referred to as „Seller“).
2. Small Business Status (VAT)
In accordance with Section 19 of the German Value Added Tax Act (UStG), no VAT is charged or displayed on invoices (Small Business Status). All prices are final prices plus shipping costs.
3. Subject of the Contract & Special Product Information
(1) The Seller offers individually manufactured kits, book nooks, dioramas, 3D prints, and digital content (downloads). (2) Material Notice: Many products are made of wood or finnboard. These are natural materials. Minor deviations in color, grain, small knots, or slight warping due to humidity are material-related and do not constitute a defect. (3) Safety Warning: All items are purely decorative and explicitly not suitable for playing (not a toy within the meaning of the Toy Safety Directive).
4. Conclusion of Contract & Cancellation
(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to order. (2) The customer may cancel orders for physical goods free of charge within 2 hours of purchase. After this period, the manufacturing process or booking/shipping preparation begins, making cancellation impossible. (3) Digital downloads are excluded from cancellation once the purchase is completed, as the provision of data occurs immediately.
5. Right of Withdrawal & Exclusion of the Right of Withdrawal
(1) Legal Exclusion for Customization: According to Section 312g (2) No. 1 BGB (German Civil Code), the right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
This applies to Katnook.de for: All kits, dioramas, book nooks, and 3D prints (miniatures), as these are manufactured only upon customer request.
(2) Legal Exclusion for Digital Content: The right of withdrawal for digital downloads expires prematurely if the customer has expressly agreed that the execution of the contract shall begin before the expiry of the withdrawal period and has confirmed their knowledge that they thereby lose their right of withdrawal.
6. Usage Rights for Digital Content
(1) Digital downloads are protected by copyright. The copyright remains with Katrin Schilke (Katnook.de). (2) The customer receives a simple right to use the data exclusively for personal use. (3) Commercial use, reproduction, modification, or distribution to third parties is prohibited. The purchase does not transfer any copyright.
7. Shipping Conditions & Delivery Times
(1) Shipping within Germany and to EU countries is handled by DHL. (2) Shipping to the USA is handled by USPS. The standard delivery time is approximately 20-30 days (average approx. 12-14 days). Delays caused by the shipping service provider are beyond the control of the Seller. (3) Shipped items cannot be stopped or recalled.
8. Warranty (Defects) & Missing Parts
(1) Statutory warranty rights apply. Defects must be reported within 14 days of delivery. (2) In the event of justified defects, supplementary performance (remedying the defect) will take place. Kits that have already been glued or damaged by improper handling are excluded from return. (3) If components are missing, a free replacement delivery of the missing parts will be made after notification (stating the order number).
9. Gift Vouchers
Vouchers from Katnook.de can be redeemed for the entire range of products during the ordering process. Cash payment is not possible.
10. Governing Law
The laws of the Federal Republic of Germany shall apply. The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
